1. Acceptance of Terms

By downloading, accessing, or using the R.E.M – RealEstate Electrical Maintenance mobile application ("App," "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.

These Terms apply to all users, including agents, licensed electricians, property managers, contractors, and administrative staff ("Users," "you").

2. Description of Service

The App is a property electrical inspection and maintenance management tool that allows Users to schedule, conduct, record, and report on electrical safety audits and smoke alarm audits for residential and commercial properties.

Features include:

• Inspection scheduling

• Audit checklists

• Photo and document uploads

• Audit result summaries

• Downloadable PDF reports

• Notifications and reminders

• Account and profile management

3. Eligibility

You must be at least 18 years old and have the legal authority to enter into these Terms to use the App.

If you are using the App on behalf of an organization, you represent and warrant that you are authorized to bind that organization to these Terms.

4. Account Registration

To use the App, you must register using a valid email address and mobile number and verify your account through a One-Time Password (OTP).

You are responsible for:

• Maintaining the confidentiality of your login credentials.

• All activities that occur under your account.

• Providing accurate, current, and complete information.

• Keeping your account information updated.

You agree to notify us immediately of any unauthorized use of your account.

5. User Responsibilities and Acceptable Use

You agree to:

• Use the App only for lawful purposes related to electrical inspections and maintenance record-keeping.

• Enter accurate inspection, audit, customer, and property information.

• Not misrepresent inspection results or audit outcomes.

• Not upload unlawful, harmful, misleading, defamatory, or infringing content.

• Not attempt to reverse engineer, decompile, modify, or interfere with the App.

• Not use the App to harass, impersonate, or violate the rights of others.

6. Content You Submit

You retain ownership of inspection data, photographs, documents, reports, and notes you upload to the App ("User Content").

By submitting User Content, you grant DREWDON PTY LTD a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, and display such content solely for:

• Operating and maintaining the Service.

• Generating reports and PDF exports.

• Providing support services.

• Improving App functionality.

You represent and warrant that:

• You own or have the necessary rights to submit the content.

• The content does not violate any laws or third-party rights.

7. Professional and Compliance Disclaimer

The App is a record-keeping and workflow management tool only.

It does not replace the professional judgment, licensing, certification, or regulatory responsibilities required of qualified electricians under applicable laws and standards, including AS/NZS standards and local electrical safety regulations where applicable.

Users are solely responsible for:

• Ensuring inspections are performed by appropriately licensed professionals.

• Ensuring compliance with applicable electrical and safety regulations.

• Verifying the accuracy of inspection findings and audit outcomes.

DREWDON PTY LTD makes no representations regarding the accuracy of data entered by Users and shall not be liable for compliance failures, property damage, injury, loss, or claims arising from inspections conducted using the App.

8. Third-Party Services

The App may utilize third-party services to support authentication, cloud storage, analytics, notifications, and application functionality.

These services may include:

 

• Firebase Cloud Messaging (FCM)

Your use of the App may also be subject to the terms and privacy policies of such third-party providers.

9. Fees

The App is currently provided free of charge.

We reserve the right to introduce subscription plans, premium features, or service fees in the future. Users will be provided reasonable notice before any charges become effective.

10. Intellectual Property

The App, including its software, design, branding, trademarks, logos, content, and related intellectual property (excluding User Content), is owned by DREWDON PTY LTD and protected by applicable intellectual property laws.

You may not:

• Copy

• Reproduce

• Modify

• Distribute

• Reverse engineer

• Create derivative works

without prior written permission from DREWDON PTY LTD.

11. Suspension and Termination

We may suspend or terminate your account if you:

• Violate these Terms.

• Provide false or misleading information.

• Engage in activities that harm the App, our business, or other Users.

You may terminate your account at any time by:

Upon termination, your right to access and use the App will immediately cease.

Sections relating to intellectual property, limitations of liability, indemnification, and dispute resolution shall survive termination.

12. Disclaimer of Warranties

THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREWDON PTY LTD DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.

WE DO NOT GUARANTEE THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR COMPLETELY SECURE.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DREWDON PTY LTD SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, BUSINESS INTERRUPTION, DATA LOSS, OR LOSS OF GOODWILL ARISING FROM OR RELATED TO THE USE OF THE APP.

OUR TOTAL LIABILITY FOR ANY CLAIM SHALL NOT EXCEED THE TOTAL AMOUNT PAID BY YOU TO US DURING THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless DREWDON PTY LTD, its directors, officers, employees, contractors, affiliates, and agents from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of:

• Your use of the App.

• Your User Content.

• Your violation of these Terms.

• Your violation of any applicable laws or third-party rights.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Victoria, Australia.

Any disputes arising out of or relating to these Terms shall be subject to the exclusive jurisdiction of the courts of Victoria, Australia, except where applicable consumer protection laws provide otherwise.

16. Changes to These Terms

We may update these Terms from time to time.

Material changes may be communicated through the App, by email, or through other reasonable means.

Your continued use of the App after such changes become effective constitutes acceptance of the revised Terms.

17. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
